Terms and Conditions for Pharmaneek SMS

  1. Introduction
    • Welcome! By participating in this program, you agree to these Terms and Conditions.
  2. Program Description
    • We may text you daily healthcare reminders (e.g. to check your blood pressure, your weight, take your medications, etc.) from {SHORT CODE NUMBER}. Marketing/promotional text messages may be sent from 317-293-1700.
  3. Opt-In Process
    • You can opt into the program via Pharmaneek.com/sign-up.
  4. Fees and Charges
    • As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive up to 9 messages per day depending on which reminders you choose and how many times daily. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
  5. Opt-Out Instructions
    • You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
  6. Recurring Messages
    • These are daily reminders.  You may receive up to 9 reminders per day.

    • For assistance or inquiries regarding the Pharmaneek Services Shortcode Program, you can reply with the keyword HELP for more assistance, or you can get help directly at sms@pharmaneek.com.
  8. Privacy Policy
    • Pharmaneek is committed to respecting and protecting your privacy. We collect and use personal data obtained from your participation in the Pharmaneek Services Shortcode Program in accordance with our Privacy Policy. This can include, but is not limited to, your phone number and any personal data contained in messages sent through the program.   9. Liability and Disclaimer
    • Pharmaneek provides the Pharmaneek Services Shortcode Program 'AS IS' and 'AS AVAILABLE' without any warranties or guarantees of any kind. To the maximum extent permitted by Indiana and federal law, Pharmaneek, its affiliates, and their respective directors, officers, employees, and agents will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Pharmaneek Services Shortcode Program. This limitation applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Pharmaneek has been advised of the possibility of such damage. Please note that telecommunications carriers are not held responsible for any delayed or undelivered messages in connection with the Pharmaneek Services Shortcode Program.  Carriers are not liable for delayed or undelivered messages
  10. Changes to Terms and Conditions
    • Pharmaneek reserves the right to modify these Terms and Conditions at any time. We will do so by posting an updated version on our website. Changes to these Terms and Conditions will become effective immediately upon posting. It is your responsibility to review these Terms and Conditions periodically for updates. Your continued participation in the Pharmaneek Services Shortcode Program following the posting of revised Terms and Conditions means that you accept and agree to the changes.
  11. Governing Law & Dispute Resolution
    • These Terms and Conditions shall be governed by the laws of Indiana. Any disputes arising from or related to these Terms and Conditions or the Pharmaneek Services Shortcode Program shall first attempt resolution by good faith negotiation within 30 days of the dispute arising. If unresolved, the dispute will be submitted to mediation administered by the American Dispute Resolution Center in Indiana. If mediation fails, the dispute shall be settled in the federal or state courts located in Indianapolis, Indiana, to which jurisdiction and venue the parties consent.
